1 TERMS AND CONDITIONS 

1.1 Parties and Acceptance These Terms and Conditions (the “Terms”) form a binding  agreement between C.S. Date Flirt Ltd (company number HE 409225) of  Chrysanthou Mylona 1, Panayides Building, 2nd Floor, Office 1, 3030 Limassol,  Cyprus (the “Company”, “we”, “us”) and every natural or legal person (“you”, “User”)  who accesses or uses the online platform located at https://joinmyfans.com (the  “Platform”). By creating an account, uploading content, purchasing access, or  otherwise using the Platform you confirm that you have read, understood, and agreed  to be bound by these Terms together with the Privacy Policy, Cookies Policy,  Anti-Money-Laundering / Know-Your-Customer Statement, Community Guidelines,  Age-Verification and Child-Protection Policy, and any other policies expressly  incorporated by reference (collectively, the “Agreement”). 

1.2 Purpose of the Platform The Platform enables eligible creators (“Creators”) to  publish and monetise lawful user-generated content (“UGC”) and allows registered  subscribers (“Fans”) to access such content through subscriptions, tips, or one-off  payments. Creators receive eighty per cent (80 %) of the gross sums actually received  by the Platform in respect of their content (“Gross Revenue”); the remaining twenty  per cent (20 %) constitutes the service fee retained by the Company (“Service Fee”). 

1.3 Key Definitions “Gross Revenue” – funds actually received by the Platform from  Fans for a specific Creator’s UGC, after deduction of payment-processor charges and  applicable taxes. “Service Fee” – the percentage of Gross Revenue retained by the Company for  hosting, payment processing, and customer support. “Content” – any text, photographs, images, audio, video, or other material uploaded to  the Platform. 

1.4 Eligibility and Territorial Restrictions The Platform is intended only for individuals  who are at least eighteen (18) years of age or, if higher, the age of majority in their  country of residence. Use of the Platform is prohibited in jurisdictions where  possession or distribution of adult content is unlawful, including Afghanistan, India,  Iran, North Korea, Pakistan, Saudi Arabia, and the United Arab Emirates. 

1.5 Account Registration and Security (a) You must supply accurate, current, and  complete information and maintain it at all times. (b) You are responsible for  safeguarding your login credentials and for all activity that occurs under your account.  (c) We may suspend, restrict, or terminate any account that fails our  identity-verification checks, breaches these Terms, or otherwise jeopardises the  integrity of the Platform. 

1.6 Fees, Payments, and Withdrawal of the Right of Withdrawal (a) Revenue Share:  eighty per cent (80 %) Creator / twenty per cent (20 %) Company. (b) Payment Processing: all card data is handled exclusively by PCI-DSS Level 1 

certified providers (currently Stripe, PayPal, and NowPayments). (c) Payout Schedule: cleared earnings are ordinarily released within five (5) business  days of a Creator’s withdrawal request, subject to any applicable anti-fraud or  compliance holds. (d) Waiver of Cooling-Off Right: by purchasing digital content you (i) request immediate  performance and (ii) acknowledge that you thereby lose the statutory 14-day  withdrawal right under Directive 2011/83/EU, Article 16(m). All sales are therefore  final. 

(e) Chargebacks and Refunds: the Company may debit or withhold any chargeback  amounts and related fines from a Creator’s balance. Accounts with a chargeback ratio  exceeding one per cent (1 %) may be suspended. (f) Taxes: you are solely responsible for reporting and paying all taxes arising from  your use of the Platform. 

1.7 Intellectual-Property and Model-Release Requirement (a) Ownership: Creators  retain all intellectual-property rights in their UGC. (b) Licence to the Company: each Creator grants the Company a worldwide,  non-exclusive, royalty-free licence to host, display, transmit, promote, and otherwise  use the UGC on or in connection with the Platform and its marketing. (c) Model Releases: Creators must obtain a signed, dated model release for every  individual depicted in their UGC, confirming that the model is at least eighteen (18)  years old and that the model consents to publication. Copies of such releases must  be produced to the Company within seventy-two (72) hours of request. 

1.8 Acceptable-Use Rules and Synthetic Content (a) Prohibited Content: under no  circumstances may Users upload material that depicts minors, non-consensual acts,  bestiality, extremist content, or any other unlawful material. (b) Synthetic Imagery: any use of computer-generated or otherwise synthetic imagery  that realistically depicts a human being must be clearly identified as such and is  permitted only where every depicted person has provided informed consent. 

1.9 Takedown Procedure In accordance with the Digital Millennium Copyright Act and  the EU Copyright Directive, rights-holders may submit takedown notices  to dmca@joinmyfans.com. Upon receipt of a valid notice, the Company will promptly  disable access to the allegedly infringing material and notify the Creator. 

1.10 Suspension and Termination Either party may terminate the Agreement at any  time for any reason. Upon termination, licences granted by Users survive only to the  extent necessary to complete pending transactions. The Company may delete UGC  thirty (30) days after termination; outstanding payment and indemnity obligations  survive. 

1.11 Arbitration Any dispute arising out of or relating to the Agreement shall be finally  resolved by arbitration under the Rules of the Cyprus Arbitration and Mediation Centre.  The seat of arbitration shall be Limassol, Cyprus, and the language shall be English. 

This clause does not apply to (i) claims in small-claims court, or (ii) applications for  injunctive relief in respect of intellectual-property rights. Users may opt out of  arbitration by emailing arbitration-optout@joinmyfans.comwithin thirty (30) days of  creating their account. 

1.12 Disclaimer of Warranties The Platform and all content are provided “as is” and  “as available” without any warranty of any kind, whether express, implied, or statutory. 

1.13 Limitation of Liability To the fullest extent permitted by applicable law, the  Company’s aggregate liability to any User for any claim arising out of or relating to the  Agreement shall not exceed the greater of (a) one hundred euro (EUR 100) or (b) the  Service Fee paid by that User in the twelve (12) months preceding the event giving  rise to the claim. 

1.14 Indemnification You agree to indemnify and hold harmless the Company, its  officers, employees, and affiliates against all losses, claims, and expenses (including  reasonable legal fees) arising out of (i) your breach of the Agreement, (ii) your UGC,  or (iii) your violation of any law or third-party right. 

1.15 Complaints and Alternative Dispute Resolution Complaints should be submitted  to support@joinmyfans.com. We will acknowledge receipt within forty-eight (48) hours  and aim to respond substantively within fifteen (15) business days. Unresolved  consumer disputes may be referred to the Cyprus Consumer Dispute Resolution  Service. 

1.16 Miscellaneous Provisions (a) Entire Agreement: the Agreement supersedes all  prior agreements or understandings. (b) Severability: if any provision is held unenforceable, the remaining provisions  remain in full force and effect. (c) Force Majeure: neither party shall be liable for failure to perform due to events  beyond its reasonable control. (d) Assignment: Users may not assign rights or obligations without prior written  consent; the Company may assign freely. (e) Notices: notices may be delivered electronically. 

1.17 Governing Law and Jurisdiction The Agreement is governed by the laws of the  Republic of Cyprus. Subject to clause 1.11 (Arbitration), the courts of Limassol have  exclusive jurisdiction.

2 PRIVACY POLICY 

2.1 Introduction This Privacy Policy explains how the Company collects, uses,  discloses, and safeguards personal data when you use the Platform. The Company  acts as data controller under Regulation (EU) 2016/679 (the General Data Protection  Regulation, “GDPR”) and Cyprus Law 125(I)/2018.

2.5 Purposes of Processing (i) deliver and personalise the Platform; (ii) process  payments and payouts; (iii) detect and prevent fraud; (iv) comply with legal obligations;  (v) send service communications and, with consent, marketing messages. 

2.6 Data Sharing and International Transfers We share data with payment processors,  cloud hosts, analytics providers, KYC vendors, and competent authorities.  International transfers rely on adequacy decisions or Standard Contractual Clauses. 

2.7 Cookies See the Cookies Policy (Section 3). 

2.8 Retention We retain data only for as long as necessary: seven (7) years for  financial records; two (2) years for support tickets; thirty (30) days for deleted content  backups. 

2.9 Security TLS encryption, role-based access controls, and regular penetration  testing. 

2.10 Your Rights Access, rectification, erasure, restriction, portability, objection,  withdrawal of consent, and complaint to the Cyprus Commissioner for Personal Data  Protection. 

2.11 Children The Platform is not intended for minors. Suspected under-age accounts  are terminated and reported.

2.12 Automated Decision-Making No automated decisions producing legal effects are  made without human review. 

2.13 Data-Processing Addendum Professional Creators may request a DPA  incorporating the EU Standard Contractual Clauses by  emailing dpa@joinmyfans.com. 

2.14 Changes We may amend this Policy; material changes will be announced on the  Platform or by email.

3 COOKIES POLICY 

3.1 Purpose This Cookies Policy describes how the Platform uses cookies and similar  technologies to recognise users and enhance functionality. 

3.2 Types of Cookies Essential – authentication and security. Performance – anonymised analytics. Functionality – remembering preferences. Targeting – interest-based advertising via third-party networks. 

3.3 Third-Party Cookies Payment processors and analytics providers may set cookies  subject to their own policies. 

3.4 Managing Cookies You may disable non-essential cookies via the on-site banner  or browser settings. Essential cookies are required for core features.

4 ANTI-MONEY-LAUNDERING / KNOW-YOUR-CUSTOMER STATEMENT 

4.1 Approach We adopt a risk-based approach consistent with EU  Directive (EU) 2015/849 and Cyprus Law 188(I)/2007. 

4.2 Identity Verification Creators must complete KYC before receiving payouts,  including submission of government ID, biometric check, and, where required, proof  of address. 

4.3 Monitoring and Reporting Transactions are monitored for unusual activity.  Suspicious Transaction Reports are filed with MOKAS as necessary. 

4.4 Sanctions Screening We do not onboard or pay individuals or entities subject to  EU, UN, OFAC, or UK sanctions. 

5 COMMUNITY GUIDELINES 

1. Consent first: upload only content you own and for which every participant has  provided written, informed consent. 

2. Zero tolerance for unlawful content: no minors, non-consensual acts, bestiality,  extremist or terrorist material. 

3. Intellectual property: do not upload third-party material without a valid licence.

4. Synthetic imagery: computer-generated likenesses must be clearly labelled and  consensual. 

5. Anti-fraud: no phishing, escort services, or trafficking. 

6. Reporting: violations may be reported confidentially to report@joinmyfans.com. 

6 AGE-VERIFICATION AND CHILD-PROTECTION POLICY 

(i) Users must confirm that they are at least eighteen (18) years old on registration  and when viewing explicit content. (ii) Creators must pass ID and biometric checks before monetisation. (iii) Fan age-verification may use billing-verification or spot checks. (iv) Breaches result in immediate termination and reporting to law enforcement and  child-safety organisations. 

7 MODEL-RELEASE AND CONTENT-LICENSING ANNEX (TEMPLATE) 1. Parties: Creator and Model. 

2. Age affirmation: Model confirms eighteen (18) years or older. 

3. Grant: worldwide, perpetual, transferable licence for all media. 4. Consideration: royalty-free; no further compensation. 

5. Governing law: Republic of Cyprus.
